Pank — Terms of Service

1. Introduction

These Terms of Service govern your use of Pank. Pank is operated by Key Real AB, a Swedish company with registered address at Kompassbacken 14, 163 44 Spånga, Sweden. By using Pank, you agree to these Terms. If you do not agree, do not use Pank.

2. What Pank Is

Pank is a platform for discovering, rating, reviewing, saving and sharing experiences. Experiences may include restaurants, bars, clubs, cafes, hotels, beaches, attractions, activities, events, shops, venues and other categories now or in the future.

Pank may include social features, recommendations, rankings, reviews, user-generated content, business listings, advertising, sponsored placements, booking features, messaging, media uploads and other features.

3. Eligibility

You must be at least 16 years old to use Pank. By using Pank, you confirm that you are at least 16 and legally able to agree to these Terms.

4. Accounts

You may browse some parts of Pank without an account. Some features require an account, including social features, ratings, reviews, saved places, uploads, friend requests and personalized features.

You may create an account using Google, Apple or other login methods we may support in the future. You are responsible for your account and for keeping access to your device and login method secure. You must not create an account using false, misleading or unauthorized information.

5. User Profiles and Social Features

Pank may allow users to create profiles, follow users, request friends, follow businesses, save experiences, create collections, interact with content and use other social features. You are responsible for your interactions with other users. Pank may limit, suspend or remove social features to protect users, businesses, the platform or the public.

6. User Content

You may be able to post, upload or submit content, including: ratings; reviews; comments; photos; videos; profile information; lists; collections; business information; reports; messages; reactions; other content.

You keep ownership of your content. However, by posting or uploading content to Pank, you grant Key Real AB a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, distribute, modify, adapt, translate, create derivative works from, use, promote and make your content available in connection with Pank, our services, marketing, business operations and future features.

This license continues for as long as necessary to operate, improve, promote and protect Pank, unless terminated by deletion where technically and legally possible.

7. Your Responsibility for Content

You must only upload content that you have the right to use. You must not upload content that: infringes intellectual property rights; violates privacy rights; contains someone's personal data without permission; is false or misleading; is defamatory; is discriminatory; is hateful; is sexually explicit; promotes violence; promotes illegal activity; contains malware; is spam; is fake or manipulated in a misleading way; impersonates another person; violates these Terms or our policies.

You are responsible for any content you submit.

8. Reviews and Ratings

Reviews and ratings should reflect genuine experiences, opinions or impressions. You must not: post fake reviews; review your own business without disclosure; accept payment or benefits for undisclosed reviews; manipulate ratings; coordinate review attacks; threaten businesses with bad reviews; post irrelevant reviews; post reviews based on discrimination or harassment; use multiple accounts to influence ratings; copy reviews from others.

Pank may remove, hide, demote, label or limit reviews that violate our policies or appear suspicious. Pank does not verify every review, rating, photo or claim.

9. Business Listings

Pank may create, display or update listings for businesses, venues, places and experiences. Listings may be based on user submissions, public information, business owners, third-party sources, partners or Pank research.

A business does not need to claim or approve a listing for it to appear on Pank. Businesses may be able to claim listings, correct factual information, respond to reviews, upload content, advertise or use other business tools in the future. Businesses cannot require removal of lawful opinions simply because they are negative. Pank may remove content that violates our policies, but we do not guarantee removal of truthful or lawful opinions.

10. Recommendations, Rankings and Scores

Pank may rank, recommend, sort, personalize or highlight experiences using algorithms, editorial decisions, popularity, location, quality signals, safety signals, commercial relationships, sponsorships, user activity and other factors. Pank may change ranking systems at any time.

Recommendations, scores, ratings and rankings are not guarantees of quality, safety, availability, legality or suitability. You are responsible for deciding whether an experience is right for you.

11. Advertising, Sponsorships and Commercial Content

Pank may include advertising, sponsored listings, promoted venues, brand partnerships, affiliate links, commissions, booking integrations or other commercial content in the future. Where required, sponsored or paid content will be labeled. Commercial relationships may affect visibility, placement or presentation, but we aim to preserve user trust and platform integrity.

12. Payments and Future Paid Features

Pank does not currently plan paid user features at launch, but we may introduce payments, subscriptions, bookings, tickets, reservations, marketplace purchases, business tools or premium features in the future. Additional terms may apply to paid features.

13. Location-Based Features

Pank may use location to show nearby experiences, calculate distances, improve search, personalize recommendations and support future features such as check-ins. Pank does not use background location tracking. You can control location permissions in your device settings.

14. Notifications

Pank may send push notifications, emails or in-app messages about account activity, friend requests, followers, recommendations, nearby experiences, trending places, product updates, marketing and service-related matters. You can control notification preferences through device settings, app settings or unsubscribe links where available.

15. Messaging and Future Communication Features

Pank may introduce messaging, comments, replies, mentions, tags or other communication tools. If introduced, you must use these features respectfully and lawfully. We may monitor, moderate, restrict or remove communications where necessary to enforce our policies, protect users, prevent abuse or comply with law.

16. Artificial Intelligence and Automated Systems

Pank may use automated systems or AI to support recommendations, rankings, moderation, spam detection, fake review detection, personalization, search, support and product improvement. You must not attempt to manipulate, reverse engineer, evade or abuse these systems.

17. Prohibited Conduct

You must not: break the law; harass, threaten or abuse others; impersonate someone; create fake accounts; scrape Pank without permission; use bots or automation without permission; manipulate ratings or rankings; upload harmful code; interfere with the service; reverse engineer the app; bypass security measures; violate intellectual property rights; collect data about users without permission; use Pank for spam; use Pank to promote illegal or harmful activities; misuse reporting tools; attempt to damage Pank, users or businesses.

18. Moderation and Enforcement

We may review, remove, hide, restrict, label, demote, disable or refuse to display content or accounts if we believe they violate these Terms, our policies or the law. We may suspend or terminate accounts. We may take action without prior notice where necessary to protect users, businesses, Pank, the public or legal compliance. We may use automated and human moderation.

19. Reporting Content

Users and businesses may be able to report content, profiles, listings, reviews, photos, videos, comments or other material. At launch, reporting tools may be limited. You can contact hello@pank.co to report urgent issues. When reporting content, include enough information for us to review the issue.

20. Intellectual Property

Pank, including our name, logo, design, software, features, algorithms, databases, interface, trademarks and content created by us, belongs to Key Real AB or our licensors. You may not copy, modify, distribute, sell, lease, reverse engineer or exploit Pank without permission.

21. Copyright Complaints

If you believe content on Pank infringes your copyright, contact hello@pank.co with: your name and contact details; identification of the copyrighted work; identification of the allegedly infringing content; a statement that you believe the use is unauthorized; a statement that the information is accurate; your signature or equivalent confirmation. We may remove or restrict allegedly infringing content and may terminate repeat infringers.

22. Third-Party Services

Pank may link to or integrate with third-party services, including Google, Apple, maps, analytics providers, businesses, booking providers, websites and advertisers. We are not responsible for third-party services, content, terms, privacy practices, availability, quality or safety.

23. No Guarantee of Experiences

Pank does not own or operate most businesses, venues or experiences listed in the app. We do not guarantee: opening hours; prices; availability; quality; safety; accessibility; legality; accuracy of listings; suitability; user reviews; business responses. Always use your own judgment.

24. Disclaimers

Pank is provided "as is" and "as available." We do not guarantee that Pank will be uninterrupted, error-free, secure, accurate or available at all times. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. Nothing in these Terms limits rights that cannot be limited under applicable consumer law.

25. Limitation of Liability

To the maximum extent permitted by law, Key Real AB is not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data, loss of goodwill, business interruption or harm resulting from your use of Pank. Our total liability is limited to the amount you paid to Pank in the 12 months before the claim, or 100 EUR if you paid nothing, unless applicable law requires otherwise.

26. Indemnity

Where permitted by law, you agree to indemnify and hold harmless Key Real AB from claims, damages, losses and expenses arising from: your content; your misuse of Pank; your violation of these Terms; your violation of law; your infringement of rights; your interaction with users or businesses.

27. Termination

You may stop using Pank at any time. We may suspend or terminate your access if you violate these Terms, create risk, misuse the service, infringe rights, break the law or harm Pank, users or businesses. Some sections survive termination, including content licenses, intellectual property, disclaimers, liability limitations, dispute terms and legal obligations.

28. Changes to Pank

We may modify, suspend, remove or discontinue features at any time. We may introduce new features, change existing features, limit availability, or require account login for certain functionality.

29. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may notify you by email, in-app notice, website notice or other appropriate method. Your continued use of Pank after changes become effective means you accept the updated Terms.

30. Governing Law and Disputes

These Terms are governed by Swedish law. If you are a consumer in the EU, you may also have mandatory rights under the laws of your country of residence. Disputes shall be handled by competent courts in Sweden, unless mandatory consumer law gives you the right to bring claims elsewhere.
